Kosmos General Terms and Conditions of Sale (GTC)

Article 1: object

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of the online sale of products offered by the company Kosmos, registered in the Trade and Companies Register under number 88491227000029, whose head office is located at 34 rue d'Hauteville 75010, France.

Article 2 : Champ d'application

These T&Cs apply to all sales of products made through the website. www.kosmos-lab.com (hereinafter referred to as "the Site") and are reserved for non-commercial individual buyers (hereinafter referred to as "the Customer").

Section 3: Products

The products offered for sale are those listed on the Site, subject to availability. Each product is accompanied by a description provided by Kosmos. The photographs in the catalog are as accurate as possible but cannot guarantee perfect similarity with the product offered, particularly with regard to colors.

Article 4: Price

Product prices are listed in euros, inclusive of all taxes (TTC), excluding delivery charges. Kosmos reserves the right to change its prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.

Article 5: Order

The Customer may place an order on the Site. The order will only be processed after receipt of payment and validation by Kosmos. Any order constitutes acceptance of the prices and descriptions of the products available for sale.

Article 6: Payment

Payment for purchases is made by credit card (Visa, MasterCard, American Express) or via PayPal. Payment is secured by an SSL encryption system.

Article 7: Delivery

Products are delivered to the delivery address specified by the Customer when ordering. Delivery times are indicated on the Website and may vary depending on the destination. Kosmos delivers to all countries in the European Union. Delivery costs are the responsibility of the Customer and are indicated when confirming the order.

Article 8: Withdrawal

In accordance with current legislation, the Customer has 14 days from receipt of the product to exercise their right of withdrawal without having to provide reasons or pay any penalties, with the exception of return costs. The product must be returned in its original packaging, unused and in perfect condition.

Article 9: Guarantee

All products supplied by Kosmos benefit from the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the Consumer Code and the guarantee relating to defects in the item sold, under the conditions provided for in articles 1641 et seq. of the Civil Code.

Article 10: Liability

Kosmos shall not be liable for any damages of any kind, whether material, immaterial, or physical, which may result from malfunction or misuse of the products sold. Kosmos' liability shall, in any event, be limited to the amount of the order.

Article 11: Intellectual Property

All elements of the Site are and remain the intellectual and exclusive property of Kosmos. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the Site, whether software, visual, or audio.

Article 12: Personal data

Kosmos undertakes to respect the confidentiality of personal data communicated by Customers on the Site and to process them in compliance with the Data Protection Act of January 6, 1978.

Article 13: Disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

Article 14: Modification of the T&Cs

Kosmos reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in effect on the date of the order.
