Terms of sale

Article 1 — Purpose

The purpose of these Terms of Sale (the "Terms") is to define the conditions under which Kosmos (the "Seller") provides its products to the customer (the "Customer"), as well as the rights and obligations of the parties in connection with the sale. Placing any order implies full and unreserved acceptance of these Terms.

Article 2 — Scope

These Terms apply, without restriction or reservation, to all sales concluded by the Seller with customers, who are natural persons of legal age acting for non-commercial purposes. They are accessible and consultable at any time on the website.

The Customer declares that they are a natural person acting in a non-commercial capacity and have the legal capacity required to order the Seller's products.

Article 3 — Orders

The Customer places the order directly on the website www.kosmos-lab.com. The Seller sends an order confirmation by email. The sale is deemed concluded upon validation of the order by the Seller.

Article 4 — Prices and payment

Prices are indicated in euros, all taxes included (VAT included). Payment is made by credit card (Visa, MasterCard, American Express) or via PayPal, including the pay-in-4 interest-free option offered by PayPal.

Transactions are secured with SSL encryption. The amount is only charged upon confirmation of the order.

Article 5 — Delivery

Products are dispatched via Colissimo, Mondial Relay or DHL within 1 to 3 business days after the order is validated, in metropolitan France. Delivery usually takes 7 to 10 business days.

Shipping costs are free for metropolitan France. In the event of an incorrect address or a parcel not collected, re-shipping the order may be carried out at the Customer's expense.

Article 6 — Withdrawal right

In accordance with the French Consumer Code, the Customer has a withdrawal period of 14 days from receipt of their order. To exercise this right, the Customer informs the Seller by email at gauthiernoepm@gmail.com before the deadline expires. The refund is issued within 10 business days of receipt and checking of the returned product, in accordance with the refund policy.

Article 7 — Guarantees

The Seller is bound by the legal guarantee of conformity set out in Articles L.217-4 et seq. of the French Consumer Code, and by the guarantee for latent defects set out in Articles 1641 et seq. of the French Civil Code.

Article 8 — Liability

The Seller's liability cannot be engaged for any damage resulting from a use of the product inconsistent with its intended purpose or from misuse by the Customer. The Seller cannot be held liable for delivery delays attributable to circumstances beyond its control.

Article 9 — Personal data

The data collected when an order is placed is processed in accordance with the applicable personal data protection regulations (GDPR). It is never transferred to third parties for commercial purposes. For more information, please consult our privacy policy.

Article 10 — Intellectual property

All the elements making up the website (texts, visuals, photographs, trademarks) are protected by intellectual property rights and remain the exclusive property of the Seller.

Article 11 — Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction.
